Who we are
eGiggs Healthcare Marketing is the Practice Growth division connected to esolutionprojects. We provide healthcare-focused website, visibility, reputation, content and practice-growth services.
This Privacy Policy applies to personal information processed through the eGiggs website, enquiries, communications and services. Where esolutionprojects or another party processes information for a separate purpose, its own privacy terms may also apply.
We process personal information in accordance with applicable South African privacy law, including the Protection of Personal Information Act 4 of 2013 (POPIA).
Information we may process
Depending on how you interact with us, we may process information such as:
- your name, role, practice or business name;
- telephone number, WhatsApp number, email address and other contact details;
- information you provide when requesting a quotation, consultation or service;
- practice information, locations, services, branding and public-facing business information supplied for a project;
- website and technical information such as IP address, browser, device, referral source and interaction data where analytics or similar technologies are enabled;
- communications and project records reasonably required to deliver or support our services; and
- information lawfully available from public sources or third-party platforms where relevant to the work you have asked us to perform.
We aim to collect only information that is reasonably necessary for a legitimate and defined purpose.
Healthcare and patient information
eGiggs generally does not require patient clinical records to provide marketing services.
Please do not send patient files, diagnoses, treatment records, identity documents or other unnecessary health information through ordinary marketing, email or WhatsApp channels.
Healthcare information can constitute special personal information under POPIA and requires heightened care. Where a project legitimately involves identifiable patient information, photographs, testimonials, reviews or other sensitive material, the healthcare provider remains responsible for ensuring that the information may lawfully be supplied and used for the agreed purpose.
We may require appropriate consent, authorisation, de-identification or other safeguards before using such material. We reserve the right to decline or remove information that should not have been supplied to us.
How we use personal information
We may use personal information where reasonably necessary to:
- respond to enquiries and communicate with you;
- prepare proposals, quotations or service arrangements;
- deliver, manage and support agreed services;
- build, maintain or improve websites and digital presence;
- manage authorised work on relevant business, search, social or content platforms;
- maintain security, prevent misuse and troubleshoot technical issues;
- keep appropriate business, contractual and compliance records;
- improve our services and understand how our website is used; and
- meet legal, regulatory or legitimate business obligations.
Our lawful basis will depend on the circumstances and may include consent, performance of an agreement, compliance with law or another lawful justification recognised by POPIA.
Marketing communications
Where we send direct marketing communications, we aim to do so in accordance with POPIA and other applicable South African requirements.
Where consent is required, we will seek it appropriately. Existing clients may receive relevant communications where the law permits this, subject to the right to object or unsubscribe.
You may ask us to stop sending marketing communications at any time. Service, project, billing, security or other necessary operational messages are not treated as promotional marketing.
Cookies and analytics
Our website may use cookies and similar technologies required for functionality, security, performance, analytics or user experience.
Depending on the technologies enabled on the website, these tools may process information about visits, devices, browsers, pages viewed and interactions. Where consent is legally required for a particular technology, we will seek it before using that technology.
You can also control or delete cookies through your browser settings. Disabling certain cookies may affect how parts of the website function.
Third-party platforms and services
Healthcare marketing often involves independent platforms and service providers. Depending on the service you request, authorised work may involve website hosting, analytics, search engines, business-profile platforms, social networks, design or communications tools.
Those providers may process information under their own privacy terms. We do not control the independent privacy practices of third-party platforms.
Where you grant eGiggs access to an account or platform, we use that access for the authorised service and expect appropriate account permissions to be used rather than unnecessary sharing of passwords wherever practical.
When information may be shared
We do not sell personal information.
Information may be shared only where reasonably necessary with authorised personnel, contractors, technology providers, professional advisers, service providers or platforms involved in delivering or supporting the relevant service, or where disclosure is required or permitted by law.
Where another party processes personal information on our behalf, we take reasonable steps appropriate to the relationship and the nature of the information to require suitable confidentiality and security safeguards.
Cross-border processing
Some technology, hosting, analytics, communications or platform providers may process or store information outside South Africa.
Where personal information is transferred across borders, we take reasonable steps to ensure that the transfer is handled in accordance with POPIA, including the requirements applicable to transborder flows of personal information.
Security and retention
We use reasonable technical and organisational safeguards appropriate to the information we process and the nature of our services. No online system can guarantee absolute security, but we work to reduce the risk of loss, misuse, unauthorised access, alteration or disclosure.
Personal information is retained only for as long as reasonably necessary for the purpose for which it was collected, to provide or support services, to maintain legitimate business records, or to meet legal and regulatory requirements. Information that is no longer required will be deleted, destroyed or de-identified where appropriate.
Your rights under POPIA
Subject to applicable law and the circumstances of the request, you may have the right to:
- ask whether we hold personal information about you;
- request access to personal information held about you;
- ask for inaccurate, irrelevant, excessive, outdated, incomplete, misleading or unlawfully obtained information to be corrected or deleted where applicable;
- object to certain processing;
- withdraw consent where processing is based on consent; and
- lodge a complaint with the Information Regulator.
We may need to verify your identity before acting on a privacy request and may retain information where the law requires or permits us to do so.
